Abstract
Die Ehe ist in vielen Kulturen ein zentrales kulturelles Erbe. Umso erstaunlicher ist es, dass die Ehe trotz wiederkehrender Problematisierungen, durch beispielsweise steigende Scheidungsraten, auch heute noch als erstrebenswert gilt, was die Öffnung der Ehe für gleichgeschlechtliche Paare im Jahr 2017 verdeutlicht. Im Rahmen dieser Arbeit soll deshalb untersucht werden, wie sich die Ehe als kulturelles Erbe davor bewahren konnte zu verdunkeln. Dabei wird die Forschungshypothese erhoben, dass die Ehe ein verdunkelungsresistentes kulturelles Erbe darstellt, was mithilfe einer diskurslinguistischen Betrachtung in den Bereichen Recht, Politik und Gesellschaft am Beispiel zweier einschneidender Gesetzesänderungen im Eherecht näher untersucht wird. Mithilfe agonaler Zentren konnten Verdunkelungsmomente in den betrachteten Zeiträumen ausfindig gemacht und anschließend im Kontext der Gesetzesänderungen im Hinblick auf eine Verdunkelungsresistenz beleuchtet werden. Dabei wurde eine Verdunkelungsresistenz festgestellt, welche weiterführend auf der Sprachoberfläche sichtbar gemacht wurde. Es zeichnete sich ab, dass die Ehe entgegen dem idealtypischen Verdunkelungsprozess durch Tilgung verdunkelter Teilkonzepte einer Verdunkelung des Gesamtkonzepts entgegenwirkt und damit verdunkelungsresistent ist.
Translation of abstract (English)
Marriage is a central cultural heritage in many cultures. It is therefore astonishing that despite recurring problematisations, for example through rising divorce rates, marriage is still considered desirable today, which is demonstrated by the opening of marriage to same-sex couples in 2017. This thesis will therefore examine how marriage as a cultural heritage has been able to keep itself from becoming obscured. Thus, the research hypothesis is raised that marriage represents a cultural heritage resistant to obscuration, which will be examined in more detail with the help of a discourse-linguistic approach in the fields of law, politics and society using the example of two significant legal changes in marriage law. With the help of agonal centres, obscuration moments could be identified in the periods under consideration and then illuminated in the context of the legal changes with regard to resistance to obscuration. In the process, a resistance to obscuration was found, which was further made visible on the surface of the language. It became apparent that, contrary to the ideal-typical obscuration process, marriage counteracts an obscuration of the overall concept by eradicating obscured partial concepts and is thus resistant to obscuration.
