Abstract

Ziel der Arbeit ist die Beantwortung der Frage, ob der 1999 in den EG-Vertrag eingefügte neue Artikel 16 das geltende Gemeinschaftsrecht bestätigt oder verändert. In Teil 1 werden zunächst die wirtschaftstheoretischen und sozialwissenschaftlichen Hintergründe sowie die möglichen Formen und Instrumente staatlichen Eingreifens in den Marktprozess präsentiert. Anschließend werden in einer vergleichenden Gesamtschau die wichtigsten nationalen Begrifflichkeiten, Traditionen, verwaltungsrechtlichen Konzepte und Strukturen der Versorgungswirtschaft in den Mitgliedstaaten der Europäischen Union vorgestellt. In Teil 2 wird das gegenwärtige Regime von öffentlichen und privaten Unternehmen, denen die Mitgliedstaaten Sonderrechte im Sinne von Art. 86 Abs. 1 EGV eingeräumt haben, in den zentralen Bereichen der Grundfreiheiten und der Wettbewerbsregeln entfaltet. Teil 3 ist einer Normanalyse der bis heute kontrovers diskutierten Ausnahmevorschrift des Art. 86 Abs. 2 EGV gewidmet, da dies die notwendige Grundlage für eine sachkundige Bewertung von Notwendigkeit und Inhalt neuerer Vorstöße zur Ergänzung der maßgeblichen Vorschriften des EG-Vertrages durch Artikel 16 bildet. In Teil 4 werden schließlich die für die Versorgungswirtschaft bedeutsamen neuen Entwicklungslinien im primären und sekundären Gemeinschaftsrecht herausgearbeitet und bewertet. Unter Einbeziehung aller bis hier gefundenen Ergebnisse ist darauf schließlich die Beantwortung der Frage möglich, was genau Normzweck und Norminhalt des neuen Art. 16 EG-Vertrag ist und welche Wirkung der Vorschrift in rechtlicher Hinsicht, insbesondere im Hinblick auf die Binnenmarktregeln, zukommt.

Translation of abstract (English)

The author analyses the legal impact of the new art. 16 EC Treaty ('services of general economic interest'), which has been implemented into the EC Treaty by the Treaty of Amsterdam in 1999. He answers the question, whether the new provision is compatible with the principles laid down by the EC Treaty and the case law of the European Court in the field of the basic freedoms and EC competition law. In part one, the author presents a survey of the economic and sociological reasons for services of general economic interest in EU member states and explains possible forms and instruments of state regulation of such services. In part two, the role of public and private undertakings to which states have granted special or exclusive rights is analysed with regard to conflicting principles of internal market rules, especially art. 86 para 1 EC Treaty. In part three, the author analyses the legal impact of the service of general economic interest exclusion laid down in art. 86 para 2 EC Treaty, which is subject to great controversy among commentators since decades. In part four, new developments in primary and secondary EC law with regard to undertakings entrusted with 'public services' are discussed. Taking account of the results found in part one to four, the author then analyses the new art. 16 EC Treaty and its legal impact on common market rules. He concludes, that art. 16 EC Treaty is merely a political statement which is fully compatible with the rules of competition and the basic freedoms of the EC Treaty and that the new provision does not allow new exclusions for states to grant special or exclusive rights to undertakings in the public sector which are inconsistent with EC common market rules. Far from being incompatible, services of general economic interest, internal market and Community competition policy are complementary in the pursuit of the fundamental objectives of the EC Treaty.
