Abstract

Der Text befasst sich aus interdisziplinärer Sicht mit dem Thema Sprache, Geltung und Recht. Das Problem der Geltung wird argumentationstheoretisch erörtert. Sowohl Sprache als auch Recht beanspruchen eine bestimmte Form von Geltung; aber lediglich das Recht ist in der Lage, seinen Anspruch definitiv durchzusetzen. Die verschiedenen Auslegungsmethoden im Verfassungsrecht bilden die Grundlage für eine Analyse bestimmter Topoi (z.B. Wortlaut), die in Urteilen verwendet werden. Zusätzlich werden hierfür realistische bzw. nicht-realistische Bedeutungstheorien (Wittgenstein I vs. II) untersucht. Eine exemplarische Analyse ausgewählter Entscheidungen des Bundesverfassungsgerichts veranschaulicht die Problematik. Der Text gibt abschließend einen Ausblick auf die systemtheoretische (Luhmann) und diskurstheoretische (Habermas) Sichtweise unseres Rechtssystems.

Translation of abstract (English)

The text deals with the topic of language, validity and law from an interdisciplinary point of view. The problem of validity is explained by the theory of argumentation. Language as well as law claim a specific validity; but only law is able to enforce its claim – definitely. The various methods of interpretation in constitutional law are the basis of an analysis of commonplaces (e.g. Wortlaut) used in verdicts. Also an inquiry of realistic respectively non-realistic theories of meaning (Wittgenstein I vs. II) is added. An exemplary analyses of selected verdicts of the Bundesverfassungsgericht clarifies the problem. Finally the text gives the prospects for our legal system seen by the social systems theory (Luhmann) and the theory of rational discourse (Habermas).
